Terms and Conditions

1. Scope of Validity
These Terms and Conditions apply to the dispatch of Castles Tour and Annual Passes (Castles Passes) of the Saxon State Palaces, Castles and Gardens (Staatsbetrieb SBG). When concluding a contract, these Terms and Conditions are acknowledged and accepted.

2. Contract
A purchase contract is established by placing an order, however, upon the supply of the Castles Pass at the latest.

3. Postage Costs
For any mailing within the Federal Republic of Germany a flat fee for shipping and handling of EURO 2.50 will be charged, regardless of quantities ordered. If to be delivered by courier, the appropriate courier fees will be charged. Costs of shipping and handling outside of Germany will be charged with 3.50 Euro.

4. Delivery
Delivery shall be made to the address stated by the purchaser. Any delivery times stated are non-obliging unless a delivery date has expressly been agreed upon.

5. Payment, Prices
Payment shall be made within two weeks net of receipt of the invoice.
Should payment not be made in due time, the Staatsbetrieb SBG shall be entitled to charge reminder fees of EURO 5.-. A third reminder shall involve a reminder fee of EURO 15.-. Should a third reminder be to no avail, the Staatsbetrieb SBG shall reserve its right to initiate a collection procedure.
Prices include the statutory VAT. Subject to price changes.

6. Liability
The Staatsbetrieb SBG shall only be held liable for intention and gross negligence. In the event of gross negligence it shall not be held liable for damage that is atypical to the contract or not foreseeable. Otherwise, the Staatsbetrieb SBG shall only be held liable for infringement of or non-compliance with substantial contractual obligations.

7. Power of Revocation
As a consumer in the sense of the German Civil Code, you are entitled to revoke your contractual declaration within two weeks of receipt of the Castles Pass. Such revocation shall be made in writing (by mail, fax or e-mail) or by returning the commodity items. The term shall begin upon delivery of the commodity items. For maintaining the term of revocation, due delivery of the revocation or of the commodity items shall be deemed sufficient. The revocation or return of the commodity items shall be directed to:

Consequences of revocation:
In the event of effective revocation, mutually received services and, if applicable, any benefits granted, shall be returned. Legal consequences resulting from any revocation shall be dealt with by statutory regulations (§ 357 BGB/German Civil Code).

8. Warranty
The statutory provisions on granting warranty shall apply. In the event of claiming warranty, claimants shall turn to the address as stated under 7 above.

9. Conditional Sale
Commodity items shall remain the property of the Saxon State Palaces, Castles and Gardens until full payment has been made.

10. Place of Jurisdiction, Applicable Law
The place of performance for any claims from the contract and the place of jurisdiction is Dresden.
The law of the Federal Republic of Germany shall apply to this contract and these Terms and Conditions.

11. Severability
Should any individual provision of these terms and Conditions be ineffective, the remaining provisions hereof shall in no way be affected.

12. Data Protection
Data are stored observing applicable provisions of data protection.
